The D.C. United States Court of Appeals threw out recently enacted Hours of Service (HOS) rules based on Federal Motor Carrier Safety Administration’s (FMCSA) failure to consider driver’s health impact as defined in the statute. Parents Against Tired Truckers (PATT) and Citizens for Reliable and Safe Highways (CRASH) had filed the lawsuit against the new HOS rules. The American Trucking Associations are encouraging the FMCSA to keep current rules in place until the issue is resolved.
