What’s next following the U.S. Court of Appeals ruling last week that the Environmental Protection Agency’s Clean Air Act standards for vehicles, and other industries including electric utilities and coal miners, is legal? The EPA had ruled that carbon dioxide is a public danger, a benchmark for current vehicle fuel economy and emissions standards, and the appeals court for the District of Columbia unanimously backed it. Some lobbyists are expecting opponents to continue challenging greenhouse gas regulations in Congress, where industry and environmental groups are expected to try and torpedo or protect the EPA rules, with some emphasizing taking away the EPA’s authority to regulate greenhouse gases under the Clean Air Act.
